MemeForge respects intellectual property rights. Here's how to report infringement and what happens next.

Overview

MemeForge respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly submitted to our designated copyright agent.

MemeForge is a hosting and website-building platform. Content published on project pages is created entirely by third-party users. We do not pre-screen or monitor user-generated content, but we will remove infringing material upon receipt of a valid DMCA notice.

Reporting Copyright Infringement

If you believe that content hosted on a MemeForge-built project page infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following to be considered valid:

  1. A physical or electronic signature of the copyright owner or an authorized agent.
  2. Identification of the copyrighted work(s) you claim has been infringed (e.g., a link to your original work or a description).
  3. Identification of the infringing material and its location on our platform — specifically the URL(s) where the infringing content appears.
  4. Your contact information: full name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Response Time: We aim to acknowledge valid notices within 2 business days and complete takedowns within 5 business days.

Counter-Notification Procedure

If you believe your content was removed from MemeForge in error or as a result of misidentification, you may submit a counter-notification. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, address, phone number, and email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if outside the United States, any judicial district in which MemeForge may be found.
  6. A statement that you will accept service of process from the person who provided the original DMCA notice.

Upon receipt of a valid counter-notification, we will notify the original complainant. If the complainant does not file a lawsuit within 10 business days, we may restore the removed content.

Filing a false DMCA notice or counter-notification may result in legal liability for damages, costs, and attorney fees under 17 U.S.C. § 512(f).

Repeat Infringer Policy

MemeForge maintains a strict repeat infringer policy. In appropriate circumstances, we will terminate the accounts of users who are found to be repeat infringers of third-party copyrights.

A user may be designated a "repeat infringer" if:

  • Two or more valid DMCA notices are received concerning content posted by that user
  • The user has been previously warned about copyright-infringing activity
  • The user has submitted a fraudulent DMCA counter-notification
  • The user has engaged in systematic or large-scale copyright infringement

Termination under this policy may occur without prior notice and without a refund of any fees paid.

User-Generated Content Responsibility

Users of MemeForge are solely responsible for ensuring that:

  • All content they upload, publish, or include in their project pages is either original or properly licensed
  • Token logos, project images, and marketing copy do not infringe third-party copyrights, trademarks, or other IP rights
  • AI-generated content prompts do not direct the system to reproduce copyrighted works
  • Any music, artwork, or media embedded in their pages is used with proper authorization

MemeForge provides tools to create and publish content but does not verify the intellectual property status of user-submitted materials. Users indemnify MemeForge against any claims arising from their use of third-party content without authorization.

Trademark Concerns

This DMCA policy specifically addresses copyright infringement. If you believe a project page on MemeForge infringes your trademark rights, impersonates your project, or constitutes passing off, please contact us separately at:

Please include details of the infringing URL, your trademark registration details, and a description of how the content creates confusion with your brand. We take trademark abuse, project impersonation, and scam pages seriously and will act swiftly to investigate credible reports.

Blockchain Content

Please note that certain content on MemeForge — specifically token metadata uploaded to IPFS and on-chain records on the Solana blockchain — is outside our ability to modify or delete once published. This is an inherent characteristic of decentralized, permissionless networks.

For IPFS-hosted content, we can remove the MemeForge platform's hosting and pinning of that content, but the content may remain accessible via other IPFS nodes or gateways outside our control. We cannot reverse blockchain transactions.

We encourage users to carefully review all content before publishing it to immutable systems.

Limitations & Good Faith

MemeForge acts in good faith in processing DMCA notices. We reserve the right to:

  • Decline to process notices that are incomplete, unclear, or fail to meet DMCA requirements
  • Request additional information to verify the validity of a claim
  • Decline to act on notices that appear abusive, retaliatory, or bad faith
  • Publish anonymized summaries of DMCA notices in a transparency report
